The Maa Kamakhya Coke Industries investigation in Guwahati entered its fourth consecutive day on Sunday, November 8, as Assam’s GST Intelligence and Enforcement Unit intensified its search over suspected tax irregularities. Investigators are examining alleged wrongful claims of Input Tax Credit (ITC) worth several crores of rupees.
Meanwhile, two of the firm’s three proprietors could face arrest if they continue to remain absent despite repeated summons. Officials are also examining multiple GST registrations linked to the business as the investigation expands.
Maa Kamakhya Coke Industries faces fourth day of GST searches
The GST Intelligence and Enforcement Unit continued its operation at Maa Kamakhya Coke Industries on Sunday. The search began on Thursday, November 5, at the firm’s office in Beltola Tiniali, Guwahati.
According to officials, the investigation focuses on suspected fraudulent Input Tax Credit claims involving transactions with allegedly non-existent taxpayers. Preliminary findings reportedly indicate that the firm may have used invoices linked to fake taxpayers to reduce its GST liability.
During the initial search, investigators seized several documents and electronic devices. They are examining these materials to verify business transactions and identify possible discrepancies in the company’s records.
The operation continued through Friday and the following days. Consequently, the investigation has now reached its fourth day, with officials continuing to collect and verify evidence.
Two Maa Kamakhya Coke Industries proprietors face possible arrest
The investigation has also intensified around the firm’s three proprietors: Anil Kumar Agarwal, Bimal Kumar Agarwal and Naveen Kumar Gupta.
The investigating team summoned all three proprietors to appear and assist with the inquiry. However, officials indicated that only Naveen Kumar Gupta, also known as Naveen Singhal, had cooperated with the investigation so far.
According to officials, Anil Kumar Agarwal and Bimal Kumar Agarwal allegedly failed to cooperate despite repeated notices. Investigators have warned that continued non-compliance could lead to their arrest.
However, no arrest of the two proprietors had been confirmed in the available reports on Sunday. The possibility of arrest remains linked to their alleged failure to respond to the investigation.
The development has added another significant dimension to the ongoing GST probe. Investigators are seeking explanations and records from the firm’s proprietors to establish the nature of the suspected transactions.
Investigation examines alleged fake ITC claims
At the centre of the Maa Kamakhya Coke Industries investigation are allegations of wrongful Input Tax Credit claims worth several crores.
Under the GST system, businesses can claim ITC for taxes paid on eligible purchases of goods and services used for business purposes. This mechanism helps prevent the cascading effect of taxes.
However, investigators suspect that the firm may have claimed credits using invoices associated with allegedly fake taxpayers. If established, such transactions could indicate an attempt to reduce tax liabilities through fraudulent documentation.
The authorities are examining the transactions, supplier details and supporting records before reaching any final findings. Therefore, the alleged irregularities remain under investigation and should not be treated as proven violations.
More GST registrations come under scrutiny
During the search, officials reportedly identified more than 10 GST registration numbers. This discovery has prompted investigators to widen their examination of the firm’s business activities and related transactions.
The team is now checking the registrations and examining whether they connect with the suspected ITC claims. Investigators are also seeking to understand the extent of the financial transactions associated with these registrations.
Additionally, officials are considering seeking assistance from the Enforcement Directorate (ED) and the Directorate General of GST Intelligence (DGGI). Such assistance could help examine wider financial and tax-related aspects if required.
The investigation could therefore extend beyond the initial search, depending on the evidence gathered and the findings of the authorities.
Maa Kamakhya Coke Industries probe puts wider business dealings under focus
Maa Kamakhya Coke Industries operates in coal trading and coke manufacturing. Its office is located in Beltola Tiniali, while its manufacturing unit is situated at Amingaon in Assam.
The ongoing investigation has brought attention to the company’s business dealings, supplier network and tax records. Officials are continuing to verify the seized material and examine the transactions under scrutiny.
Separately, another GST operation is underway at Mahalakshmi Continental, a business owned by Naveen Singhal. However, authorities have not yet established the nature of the alleged irregularities at that establishment.
For now, the immediate focus remains on the fourth-day search and the response of the two proprietors who allegedly failed to cooperate. Their appearance before investigators could prove important to the next stage of the inquiry.
The GST department’s findings will determine whether the suspected irregularities lead to further legal action. Until then, the allegations against the firm and its proprietors remain subject to investigation.
