In a major setback for the BJP-led government in Tripura, the Supreme Court has upheld the recruitment process of over 8,500 staff, including Tripura Civil Service (TCS) and Tripura Police Service (TPS) officers, initiated during the previous Left Front rule.
A division bench comprising Justices J.K. Maheshwari and Rajesh Bindal delivered the verdict, emphasizing that recruitment carried out under prevailing laws and statutes cannot be arbitrarily cancelled by a succeeding government. The bench observed, “Such cancellation of personnel engaged in the recruitment process must be rational, objective, and consistent with the rule of law.”
Background of the Dispute
The matter reached the apex court through an appeal filed by Partha Das and others against the state government’s decision to suspend recruitments. Petitioners included candidates who had applied for positions as TSR jawans, TCS and TPS officers, and boiler inspectors.
Towards the end of the Left Front’s tenure, appointment letters for 506 TSR jawans had already been prepared, and recruitment for TCS, TPS, and boiler inspectors was in advanced stages. However, soon after taking office on March 9, 2018, the BJP-led government froze the process through a cabinet decision dated March 14. On June 5, a new recruitment policy (NRP) was introduced, and by August 20, all recruitments initiated under the Left regime were formally cancelled.
Court’s Key Observations
The Supreme Court made it clear that recruitment processes initiated by a previous government cannot be unilaterally annulled by its successor. Since the selection of 506 TSR jawans was completed and other recruitment procedures were substantially advanced, the newly framed NRP could not be applied retroactively.
The judgment, grounded in legal precedents and established case laws, is being hailed as a landmark ruling that protects aspirants from arbitrary administrative decisions.
